Bally's Twin River Not Liable for Patron's Off-Site Robbery, Federal Judge Rules

A Massachusetts federal judge has dismissed a lawsuit against Bally's Twin River Casino, ruling the casino had no duty of care to a patron who was robbed and beaten 50 miles from the premises in August 2021.

Edward Peduto filed the lawsuit in May, claiming his attackers identified him as a target at Twin River Casino. Security footage showed the suspects following him through the casino and into the parking lot before tailing him by car. The assault occurred when Peduto stopped at a North Lexington, Massachusetts service station, resulting in severe injuries and over $46,000 in medical bills.

The plaintiff's legal team argued that Bally's Twin River and owner UTGR failed to provide adequate security and properly monitor casino patrons. They cited at least eight similar robberies near the premises and 76 violent incidents between January 2019 and the attack.

Judge Allison D. Burroughs rejected these arguments, noting that security cameras merely showed the suspects leaving the premises simultaneously with Peduto, displaying no illegal behavior at the time. She emphasized that a duty of care depends on the foreseeability of preventable harm.

"The attack occurred approximately fifty miles from Defendant's premises, well away from Defendant's security or control," Burroughs wrote in her dismissal. The case was dismissed without prejudice, meaning it cannot be refiled.
