RAV Bahamas, owned by Florida's Capo family, claims they've received no return on investment, alleging Genting turned the project into a "financial wasteland" with $885 million in debt.
Genting argues the case should be dismissed because:
- It's a shareholder dispute that should be handled in the Bahamas
- The claims are time-barred, dating back to 2014
- The complaint fails to prove false statements or knowledge of untrue claims
- The allegations of self-conspiracy and interference with its own business relationship are legally unsupportable
Project Background:
- RAV developed Bimini Bay resort from 2002-2011
- In 2012, Genting partnered with RAV to add a casino
- They formed BB Entertainment (BBE) for the venture
RAV alleges Genting:
- Denied access to BBE's financial records
- Refused requests for independent audits
- Created debt exceeding the combined liabilities of Genting Malaysia and its 150 subsidiaries
- Used complex corporate structures to conceal financial improprieties
Genting maintains these allegations are "baseless and without merit," while the case awaits court decision.
